TERMS AND SERVICE OF SILVIYA

Silviya, referred to as "we," "us," or "our," operates the website located at www.silviya.co (the "Site"). By accessing or using the Site, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Site.

It is mandatory that all packaging material must be return along with products i.e. Box, Silviya Jewellery Kit, free gift, etc . with original invoice. Once the product reaches our warehouse, quality check is done and refund is processed within 48 hours. All the return product opened at our warehouse for quality check under the CCTV surveillance.

If requested by you, we will re-send the same design or in case of non-availability we will initiate the return and refund process. All refunds will only be done when the product reaches at our warehouse and quality check is done. Products that are damaged or modified by the customer may not be accepted.

In case of missing items in return orders, i.e., where the customer claims to have returned multiple products but actual pickup doesn’t include all said items, the company has a right to deduct an amount up to the full MRP of the missing product from the refund amount. This shall extend to promotional products, including but not limited to free gifts and silver coins. 

Due to the nature of the product, we do not accept returns for Nose Pin, Silver Idols, Silver Coins and silver Utensils categories etc. For any assistance, please WhatsApp : +91 9310018573.

1. GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time. Your use of the Site is at your sole risk. The service is provided on an "as is" and "as available" basis. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the service, use of the service, or access to the service without express written permission from us.

2. ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION
We do not guarantee that the information on our Site is accurate, complete, or current. We reserve the right to modify the contents of the Site at any time, but we have no obligation to update any information on the Site.

3. MODIFICATIONS TO THE SERVICE AND PRICES
We reserve the right to modify or discontinue the service (or any part of it) at any time without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the service.

4. PRODUCTS OR SERVICES
Certain products or services may be available exclusively online through the Site. We reserve the right to limit the sales of our products or services to any person, geographic region, or jurisdiction. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations.

5. ACCURACY OF BILLING AND ACCOUNT INFORMATION
You agree to provide current, complete, and accurate purchase and account information for all purchases made on the Site.

6. OPTIONAL TOOLS
We may provide you with access to third-party tools over which we have no control or input. Any use of optional tools offered through the Site is entirely at your own risk and discretion.

7. THIRD-PARTY LINKS
Certain content, products, and services available via our Service may include materials from third-parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites.

8. PERSONAL INFORMATION
Your submission of personal information through the Site is governed by our Privacy Policy.

9. ERRORS, INACCURACIES, AND OMISSIONS
Occasionally there may be information on our Site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability.

10. PROHIBITED USES
You are prohibited from using the Site or its content for any unlawful purpose.

11. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free.

12. INDEMNIFICATION
You agree to indemnify and hold us harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service.

13. SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law.

14. TERMINATION
These Terms of Service are effective unless and until terminated by either you or us.

15. ENTIRE AGREEMENT
These Terms of Service constitute the entire agreement between you and us and govern your use of the Site.

16. GOVERNING LAW
These Terms of Service shall be governed by and construed in accordance with the laws of India.

17. CHANGES TO TERMS OF SERVICE
We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website.

ADDITIONAL TERMS AND CONDITIONS
i) 7-Day Returns: You can return your item within 7 days from the date of delivery for a full refund, subject to successful inspection of the items (which may take up to 7 days from receipt at Silviya's warehouse/store) and submission of a video showcasing the return packaging with the original product, invoice, and authenticity certificate. Personalised and Made-To-Order products are not eligible for 7-day returns and can only be returned in case of spurious/defective products.

ii) Non-Receipt Claim: Claims for non-receipt of a product or an empty box will be entertained only if submitted within 24 hours of receipt, along with an unboxing video that includes the original outer seal.

iii) Buyback Policy: We offer a lifetime buyback policy for items (i.e., silver items) purchased with www.silviya.co. Making charges and GST cannot be refunded. An additional 3% of the buyback value will be deducted as processing charges. Refunds will be processed to your original payment method and may take 7-10 days after product inspection and acceptance. The Silviya reserves the right to refuse acceptance of significantly damaged products. All decisions of Silviya shall be final and binding.

AGREED/ACCEPTED PROCESS:
Original receipt/proof of purchase is required for buyback claims with Silviya.

The customer needs to arrange delivery to the registered office address.

The final refund amount will be calculated based on the current silver rate and weight of the item.

iv) Price Variation: The price on the website/app is based on the average product weight. Actual product weight may vary, resulting in a minor excess charge/refund, which will be communicated within 48 hours of placing your order. You have the option to cancel your order within 24 hours of this communication. In case of COD, full payment is requested upfront. Any excess amount collected will be refunded, and any short collection will be requested within 48 hours after delivery. The weight communicated in the invoice shall be the final weight.

v) Refund Timeframe: Refunds take a minimum of 7-10 working days from the date of receipt of the jewelry at our store/central warehouse.

vi) Authenticity Certificate: To avail any features offered in the authenticity certificate (return, exchange, buyback, or warranty), you must produce the original invoice (hard/soft copy). The absence of any documents will make the product ineligible for return/exchange/warranty.

vii) Exchange and Buyback: Exchange and buyback are only valid for purchases from www.silviya.co. Any other jewelry/article/coins will not be accepted, regardless of brand/purity, etc.

viii) 6-Month Warranty: We offer a limited six-month warranty on our silver jewelry from the date of delivery. This warranty covers pre-existing damages or manufacturing defects and does not cover wear and tear. If we cannot repair the item, we will, at our discretion, replace it with another item of equal value. However, the warranty does not apply to damages due to mishandling, negligence, impact damage, accidents, tampering, etc., or surface finish/color of the product and loss of stones.

xi) Product Variation: Please note there might be up to a 2% variation in the weight/dimensions/color of the product against the mentioned specifications.
